Performance Recording and Wagyu Breeding Values Terms and Conditions.

By submitting performance data to the Australian Wagyu Association and participating the Wagyu Breeding Value (WBV) Evaluation, the Member agrees to the following Terms and Conditions. A material breach of these conditions may result in suspension or cancellation of access to genetic evaluation services.

1.Introduction
1.1 The Australian Wagyu Association (AWA) provides the WBV evaluation for registered Wagyu and Wagyu-influenced cattle.
1.2 The Evaluation uses advanced statistical methodologies to calculate WBVs from data collected by Members, including but not limited to pedigree, parentage, performance, carcase, reproductive and genomic information.

2. Use of Information
2.1 The Member authorises and grants permission for all pedigree, parentage, genomic and performance data submitted to the Australian Wagyu Association to be combined with data submitted by other Members for the purpose of evaluating the genetics of Wagyu cattle.
2.2 The Member authorises and grants permission for the Australian Wagyu Association to use submitted data for research, development and genetic improvement initiatives conducted by the Association or approved third-party organisations for the benefit of the Wagyu breed and AWA Members.

3. Collection of Information
3.1 The Member warrants that all performance data, including but not limited to calving, liveweight, carcase, and fertility records submitted to the Australian Wagyu Association has been collected in accordance with current AWA data collection protocols and guidelines (protocols and guidelines are included the AWA Knowledge Centre
3.2 Specifically for carcase performance data (e.g. carcase weight, marbling score, eye muscle area), the Member warrants that data supplied to the AWA is a true and accurate copy of the carcase data feedback supplied by the processor including being aligned to the correct Wagyu or Wagyu influenced animal.
3.3 The Member warrants that all submitted data has been collected using appropriate, calibrated and correctly functioning equipment and systems.
3.4 The Member warrants that contemporary groups will be managed in such a way as to ensure that all animals allocated to a particular group have an equal opportunity to express their genetic potential. Animals receiving preferential treatment, or animals that are sick or otherwise disadvantaged, shall be identified through appropriate management grouping records that is submitted with performance data.
3.5 Performance data will only be accepted for animals, if they are owned by the submitting Member at the performance measurement date.

4. Publication of Wagyu Breeding Values
4.1 The Member authorises and grants permission for the Australian Wagyu Association to publish outputs from the WBV Evaluation, including but not limited to Wagyu Breeding Values (WBVs), Selection Indexes and Accuracy values, on the AWA website, AWA Helical database and other Association publications.
4.2 When displaying outputs from the Wagyu Breeding Value Evaluation and associated genetic evaluation services, including sale catalogues, websites, advertisements and promotional materials, the Member warrants that:

4.2.1WBVs, Selection Indexes and Accuracy values will be clearly identified as outputs of the AWA’s WBV Evaluation.
4.2.2 WBVs, Selection Indexes and Accuracy values displayed will be current and accurate.
4.2.3 A consistent set of WBVs, Selection Indexes and Accuracy values will be displayed for all animals within a sale offering or publication.
4.2.4 All WBVs and Selection Index values less than zero (0) will be displayed with a clear negative (-) sign where applicable.
4.2.5 The analysis in which the WBVs, Selection Indexes and Accuracy values have been calculated will be clearly identified (for example, “WBV Publication Date 2026-06-25”).
4.2.6 Appropriate explanatory notes and breed benchmark tables will be displayed alongside the WBVs, Selection Indexes and Accuracy values.
4.2.7 Parental or ancestor WBVs, or calculated mid-parent WBVs, shall not be used in lieu of individual animal WBVs.
4.2.8 Where other information is displayed in association with WBVs, Selection Indexes and Accuracy values, including phenotypic records, carcase measurements or overseas genetic evaluations, it shall be clearly differentiated and identified as not being WBV Evaluation outputs.
4.2.9 The following statement will be displayed alongside the WBVs, Selection Indexes and Accuracy values:

The Wagyu Breeding Values and Selection Indexes contained within this publication were calculated from data supplied to the Australian Wagyu Association by Members and/or third parties. Whilst every effort is made to ensure the accuracy of the data, the Australian Wagyu Association, its officers and employees assume no responsibility for the accuracy of the Wagyu Breeding Values or Selection Indexes, nor for the outcome (including consequential loss) of any action taken based upon the information presented in this publication.

5. Fees
The Member agrees to pay all fees, charges and levies relating to Wagyu Breeding Value Evaluation services, genomic evaluations and associated programs as prescribed by the Australian Wagyu Association from time to time.

6. Intellectual Property
6.1 The Australian Wagyu Association acknowledges that the Member retains ownership of the original pedigree, genomic and performance data submitted by the Member.
6.2 The Member irrevocably authorises the Australian Wagyu Association to retain copies of all submitted data for inclusion in genetic evaluation systems, benchmarking databases, research projects and commercial applications, even if the Member subsequently ceases participation in the Wagyu Breeding Value Evaluation.
6.3 Upon written request, the Australian Wagyu Association will use reasonable efforts to provide the Member with copies of their submitted data in electronic format.
6.4 The Member acknowledges that the Australian Wagyu Association retains all intellectual property rights in the outputs of genetic evaluation systems, including but not limited to Wagyu Breeding Values (WBVs), Selection Indexes, Genetic evaluation outputs, Genomic evaluation outputs.

7. Disclaimer
7.1 The Australian Wagyu Association may rely upon third-party software providers, genomic service providers, laboratories and specialist contractors in the delivery of genetic evaluation services. The Association does not warrant the accuracy of third-party systems.
7.2 The Australian Wagyu Association does not directly supervise or independently audit all pedigree, performance, carcase, fertility or genomic data collection undertaken by Members or third parties.
7.3 Wagyu Breeding Values and Selection Indexes provide estimates of an animal’s genetic merit based upon available information and should not be relied upon as guarantees of future performance.
7.4 The Australian Wagyu Association, its officers, directors and employees assume no responsibility for losses arising from reliance upon genetic evaluation outputs.

8. Limitation of Liability
8.1 The Member acknowledges and agrees that the Australian Wagyu Association has not made any, and hereby excludes, all warranties, terms, conditions or undertakings, whether express or implied, written or oral, statutory or otherwise, including any implied warranty of merchantability or fitness for a particular purpose in respect of the provision of genetic evaluation services.
8.2 To the maximum extent permitted by law, the Australian Wagyu Association shall not be liable for any consequential, special, indirect or incidental loss, damage, cost or expense (including, without limitation, Loss of profit, Loss of revenue, Loss of data, Loss of business opportunity, Loss of genetic opportunity, Loss of anticipated earnings, Economic loss of any kind, Loss of goodwill) arising from participation in, or reliance upon, the Wagyu Breeding Value Evaluation or associated genetic evaluation services.


Member Acknowledgement
By submitting performance data and participating in the WBV Evaluation and associated Australian Wagyu Association genetic evaluation services, the Member acknowledges that they have read, understood and agree to be bound by the terms and conditions outlined herein, and with all current Australian Wagyu Association rules, by-laws, data collection protocols, policies and fee schedules.

Definitions

For the purposes of this Terms and Condition document:

Accuracy Value means the published measure expressing the reliability of a Wagyu Breeding Value based upon the quantity and quality of information available for an animal.

Association means the Australian Wagyu Association Ltd (AWA), its successors and assigns.

Contemporary Group means a group of animals that have been managed under substantially the same conditions and have had an equal opportunity to express their genetic potential.

Evaluation means the Wagyu Breeding Value (WBV) Evaluation conducted or administered by the Association.

Fees means all charges, levies, service fees and other amounts payable by a Member to the Association in connection with the Evaluation and associated services.

Genetic Evaluation Services means all services provided by the Association relating to genetic analysis, genomic testing, genetic benchmarking, genetic predictions, selection indexes, Wagyu Breeding Values and related technologies.

Genomic Data means DNA-based information, genomic test results, genotypes, genomic predictions and any associated genetic marker information submitted to or generated by the Association.

Intellectual Property Rights means all present and future intellectual and industrial property rights throughout the world, including copyrights, patents, trademarks, designs, confidential information, trade secrets, database rights and similar proprietary rights.

Member means any person, corporation, partnership, trust or other entity participating in the Evaluation or receiving Genetic Evaluation Services from the Association.

Parentage Data means pedigree information, sire and dam identification records, DNA parent verification information and any associated ancestry records submitted to the Association.

Performance Data means any phenotype, measurement, observation or production record submitted in relation to an animal, including but not limited to growth, fertility, carcass, structural, health, feed efficiency and management information.

Selection Index means an economic index calculated by the Association which combines multiple Wagyu Breeding Values into a single value designed to assist in selection decisions for a defined production objective.

Submitted Data means all information provided by a Member to the Association, including pedigree, parentage, genomic, performance, carcass, reproductive, management, ownership and animal identification records.

Third Party means any person, corporation, organisation, service provider, research institution, laboratory, contractor or other entity other than the Member or the Association.

Wagyu Breeding Value (WBV) means an estimate of the genetic merit of an animal for a particular trait, calculated through the Wagyu Breeding Value Evaluation using pedigree, performance, genomic and other relevant information.

Wagyu Breeding Value Evaluation means the genetic evaluation system operated, commissioned or approved by the Association for the calculation of Wagyu Breeding Values and associated genetic predictions.

Website means any website, online portal, database or digital platform owned, operated or authorised by the Association.

IMPORTANT NOTICE - Terms & Conditions


It is a condition of use of this database that you accept these terms and conditions. 

It is important that you appreciate when accessing the Australian Wagyu Association Limited (AWA) database (which may be hosted on an external website) that the information contained on the AWA database, including but not limited to pedigree, DNA information, Wagyu Breeding Values (WBVs) and Index values (together called Database Information), is based on data supplied by AWA members and/or third parties. 

Whilst sincere effort is made to ensure the Database Information is accurate and complete, to the extent permitted by law, AWA, its officers and employees, shall not be responsible for its use or interpretation, and you use the Database Information at your own risk. Please be aware of the following limitations of the Database Information.  

Regarding WBVs and Index values, it is important to appreciate, and you need to be aware that: 

  • WBVs are derived using genetic evaluation technology developed for the AWA, using information contained within the AWA database and parameters derived from it.
  • WBVs are estimates of genetic potential of individual animals and may change with addition of new data or with new parameters.
  • WBVs are genetic merit estimates only and may not reflect the raw animal phenotype.
  • WBVs can only be directly compared to other WBVs calculated in the same AWA genetic analysis.

Regarding pedigree and DNA testing results submitted to the AWA, it is important to appreciate, and you need to be aware that: 

  • Animals whose registration identifiers start with PED are Pedigree Recorded Animals. What this means is that the details which AWA used to register the animal were obtained from a Recognised Wagyu Registry Organisation – in other words a Wagyu breed association based outside of Australia. AWA has not independently verified the information with respect to the animal or the details recorded about the animal. You should read AWA’s by-laws which set out details regarding the definition of a Pedigree Recorded Animal. 
  • Pedigree and DNA data submitted and supplied to AWA may have errors in it which cannot be detected without further DNA testing. 
  • Technology may have advanced since a particular test was undertaken so that genetic issues or inaccuracies which were previously not detectable are now able to be detected by current testing technology (i.e. if the animal was tested again with current technology). 
  • AWA estimates that less than 1% of the pedigree entries, ownership or breeding details in the AWA Herdbook may have errors or which may be misleading. For this reason, users ought to consider if they need to obtain independent testing of the relevant animal (if possible) to ensure that the data is accurate. 

Regarding prefectural content, it is important to appreciate, and you need to be aware that: 

  • Prefectural content is based on the estimation of prefectural origin from Japanese breeding records of 201 foundation sires and 168 foundation dams. As genotype-based parent verification is not used in Japan, and full Japanese registration certificates are not available for all foundation animals, exact prefectural composition for these sires and dams cannot be validated. 
  • The calculation of prefectural content for Australian Herdbook animals relies on the accuracy of pedigree records and DNA samples provided by AWA members.   

Regarding DNA testing and genetic condition results submitted to the AWA, it is important to appreciate, and you need to be aware that: 

  • As genetic testing results are provided by independent DNA testing laboratories at the request of AWA members, AWA relies solely on the accuracy of the reporting of genetic testing as completed by the laboratories. 
  • AWA uses GeneProb software to calculate the likelihood of pedigree animals being a carrier of genetic conditions.  This likelihood is an estimate based on the available genetic testing results. 

If you consider that you do not understand or appreciate the nature and/or implications of the data provided on this website or the WBVs of a particular animal, then AWA strongly recommends that you seek expert advice.  Note there is substantial technical information and articles on the Wagyu website to assist our members. 

AWA’s liability for any loss or damage, consequential or otherwise, suffered or incurred by you or your related business, arising directly or indirectly from your use of Database Information, to the extent permitted by law, is limited to AWA providing you with a refund for the fees paid for the service (if any), or AWA re-performing the service, where possible, at the election of AWA.  

AWA administers this database in good faith to support AWA members and the industry. AWA does not represent or warrant that the animals recorded in this database, or animals breed from them, will achieve any particular genetic or phenotype performance.
